These Terms and Conditions (“Terms”) apply to purchases, bookings, registrations and participation in seminars, workshops, activities and related services offered by DISCOVERTHAINATURE CO., LTD. (“Discover Thai Nature”, “DTN”, “we”, “us” or “our”), company registration number 0225568000202. By placing an order or attending an activity, you agree to these Terms.
Nothing in these Terms excludes, restricts or modifies any right, remedy, guarantee or liability that cannot lawfully be excluded or restricted under applicable consumer-protection law.
1. Seminar services and eligibility
Our seminars and activities provide educational and practical experiences relating to Thai botany, agriculture, food, culture and related soft-power activities. Participants are responsible for ensuring that the selected programme is suitable for their personal circumstances and intended purpose.
We may refuse or end participation where reasonably necessary for safety, unlawful conduct, material disruption, non-payment or a serious breach of these Terms. Any statutory rights remain unaffected.
2. Prices, booking and payment
A booking is confirmed only after successful payment and our confirmation of the order. Prices are shown in Thai Baht unless stated otherwise. Customers are responsible for bank, card, currency-conversion and other third-party charges. We may correct an obvious pricing or description error before providing the service and will offer an appropriate remedy where required by law.
3. Standard cancellation and refund policy
Except where mandatory law requires otherwise, or where we cancel a service without providing an agreed alternative, seminar purchases are final and non-refundable. A change of mind, scheduling conflict, travel disruption, failure to attend, visa-processing delay or visa refusal does not by itself create an automatic right to a refund.
4. Discretionary DTV soft-power refusal refund
Without admitting any legal obligation and as a voluntary gesture of goodwill, DTN may grant an ex gratia refund equal to 80% of the seminar fee actually paid where a competent Royal Thai Embassy or Consulate issues a final written refusal of a Destination Thailand Visa application and the stated reason for refusal is specifically that the seminar or activity booked from DTN is not accepted as a qualifying Thai soft-power-related activity.
The remaining 20% is retained toward administrative, documentation, payment-processing and programme-planning costs. The goodwill refund applies only to the seminar fee received by DTN. It does not include visa or embassy fees, travel expenses, accommodation, insurance, currency losses, bank charges or other third-party costs.
This goodwill policy does not apply where the refusal results from another ground, including insufficient financial evidence, an incomplete or inaccurate application, missing documents, immigration history, identity or passport issues, application from an ineligible location, failure to respond to an embassy request, late submission, withdrawal, or a refusal that does not clearly identify the booked DTN activity as the relevant reason.
Evidence and verification
A request must be sent to contact@discoverthainature.com within 30 calendar days after the written refusal. It must include the DTN order number and proof of payment, the applicant’s full name, the visa application or reference number, and the complete refusal notice or rejection email. Clear screenshots or a PDF may be accepted if they show the sender, recipient, date, reference number and stated reason. Unrelated sensitive information may be redacted, provided the remaining evidence is sufficient to verify the claim.
By requesting the goodwill refund, the applicant authorises DTN to use the submitted information for fraud prevention and claim verification and, where reasonably necessary, to contact the relevant Royal Thai Embassy or Consulate to confirm the authenticity and stated basis of the refusal. We may request additional information reasonably required for verification.
Once the evidence and qualifying reason have been satisfactorily verified, including confirmation with the relevant embassy or consulate where DTN considers this necessary, the approved 80% refund will be initiated to the original payment method where reasonably possible. We aim to initiate an approved refund within 14 business days after verification; banks and payment providers may require additional processing time.
5. Visa and immigration disclaimer
DTN is an independent seminar provider. We are not a government agency, embassy, consulate, immigration authority or law firm. We do not issue visas and do not control visa criteria, processing times, document requests, decisions or changes in government policy.
Any invitation, enrolment confirmation, schedule or supporting document supplied by DTN confirms only the genuine booking or participation described in that document. It is not a representation or guarantee that a visa will be approved. The applicant remains solely responsible for checking the current requirements of the competent embassy or consulate and for submitting a complete, accurate and timely application.
6. Programme changes and force majeure
We may make reasonable changes to instructors, timing, venue, activities or programme order where necessary. If an event outside our reasonable control prevents or materially delays performance, including severe weather, natural disaster, epidemic, government action, transport interruption or venue closure, we may reschedule the service or offer another reasonable solution. Mandatory legal rights remain unaffected.
7. Participant health, safety and conduct
Activities may involve farms, gardens, outdoor environments, plants, foods, tools, insects, heat, uneven ground and travel. Participants must follow safety instructions, use reasonable care and promptly disclose relevant allergies, dietary restrictions, medical conditions or accessibility needs. Participation is voluntary and at the participant’s own risk to the extent permitted by law.
DTN is not responsible for loss or injury caused by a participant’s failure to follow instructions, undisclosed medical or allergy information, unlawful conduct or negligence. Nothing in these Terms excludes liability that cannot legally be excluded, including liability arising from fraud, wilful misconduct or gross negligence where applicable.
8. Photography and video recordings
Photography and video recording may take place during our seminars and at our venues. Photographs and recordings may include participants and may be used, reproduced and published by DTN for promotional and marketing purposes, including on our website, social-media channels, printed materials and advertising campaigns. Where consent is required by applicable law, we will request it. Participants who do not wish to be photographed or recorded should notify our staff before the seminar begins, and we will take reasonable steps to respect that request; however, we cannot guarantee exclusion from wide-angle, group or incidental background recordings.
9. Intellectual property and permitted use
Seminar materials, presentations, photographs, graphics, recordings and written content supplied by DTN remain protected by applicable intellectual-property rights. They are provided for personal, non-commercial use and may not be reproduced, sold, published or used to provide competing services without prior written permission.
10. Privacy and claim documentation
We process personal information for bookings, service delivery, legal compliance, customer support and refund verification. Visa-refusal evidence should include only information reasonably necessary to assess the request. Further details are provided in our Privacy Policy.
11. Limitation of liability
To the maximum extent permitted by applicable law, DTN is not liable for indirect, incidental, consequential or special losses, or for losses caused by visa decisions, third-party providers, travel arrangements or events outside our reasonable control. Where liability may lawfully be limited, DTN’s aggregate liability arising from the relevant booking will not exceed the seminar fee actually paid for that booking.
12. Governing law and disputes
These Terms are governed by the laws of Thailand. The parties should first attempt to resolve a dispute in good faith by contacting DTN. Subject to any mandatory consumer forum or jurisdiction that applies, disputes will be submitted to the competent courts of Thailand.
